Powers of Attorney

It is important to ensure that if, sometime in the future, you are unable to cope with your own financial, administrative and personal welfare affairs, you have taken steps to legally appoint someone else to be able to do all that for you.  In most cases people wish to appoint a spouse or a close relative/s.  We are able to offer you a private, personalised and confidential service allowing you time to consider all your options before signing your Power of Attorney.  We will take care of the whole procedure from taking your initial instructions through to registration of the Power of Attorney with the Office of the Public Guardian.  We are happy to visit you at home if you are unable to come to us for your initial appointment and that is all included as part of the service.

This is a highly recommended course of action to be considered seriously as you get older because you just "never know what is around the corner".  You will be provided with an exact cost at the outset which will include the registration fee.

Guardianship

If a Power of Attorney has not been put in place for an adult who has lost capacity to deal with his or her own affairs, then the only course of action would be to seek either an Intervention or full Guardianship order to be able to deal with the adult's financial affairs or their welfare.  It is a more complex and lengthier procedure compared to an adult granting a Power of Attorney however we have experience of obtaining such orders and would be able to assist you in what may be a very difficult time for you. Legal fee is in the region of £280 + vat for a single PoA appointing up to 2 Attorneys and, for couples, in the region of £500 + vat appointing the same 2 Attorneys in each deed.  The registration fees payable to the Office of Public Guardian are available on their website at: https://www.publicguardian-scotland.gov.uk/power-of-attorney/fees
